Website Law Compliance

There are specific legal requirements that websites must meet to do business legally on the Internet. Does your website meet these requirements?

Let's see how your site matches up! Compare the list below to your website.
Note:  If any of these applies to you or your business, it means you may be liable and your site determined to be non-compliant.

  • You or your business are required to comply, no matter what country you live in.

  • Your business is involved in online marketing or advertising and use your website or other people's websites for this purpose (like affiliates).

  • You are selling Health prodocts or Nutritional products on the web which means you are required to understand and comply with the FDA (Food and Drug Administration) rules and regulations.

  • Your site does not have a Privacy Policy because you didn't know it was necessary.

  • Your site has a Privacy Policy but it doesn't cover the "Child Online Protection Act.

  • You sell products or services on your site and accept credit/debit cards but you don't have a Purchase Agreement. How will you cover yourself for credit card fraud from your customers?

  • If you have a Purchase Agreement, does it give you the right to contact customers or rent and sell their data to others?

  • Does your Purchase Agreement limit the warranty on items purchased to just those product's value and nothing more?

  • The 10 Requirements for Website Law Compliance

  • Always have a Terms of Use Agreement. It must include the Child Online Privacy Act statements in it.

  • Always have a Privacy Policy that states what you do with information you collect.

  • If you make income claims on your site; be careful! You MUST tell people that not everyone will make money when they buy or use your product.

  • Always have a Purchase Agreement and Disclaimer. It states the rights and obligations of both the buyer and the seller.

  • If you make results claims on your site stating that your product or service will deliver specific results, you must advise people that it may not deliver the same kind of results to everyone and may not deliver any results to some people.

  • If you make earnings claims on your site and you make statements about your own success or that of others who have purchased your product or service; you must tell people that not everyone will make money and the results are not average.

  • Never provide misleading or deceitful information on your website. Never use that information to promote or sell a product or service.

  • Be careful with the information you provide on your site and take extra steps to ensure it is accurate. Also, you need to tell your customers that they accept full responsibility for any harm caused them by bad information.

  • Don't promote any type of pyramid or ponzi scheme, or chain letter on your website.

  • Don't promote a product and state that it will cure something. Although it may actually cure people of something, not everything works for everyone at all times and in all situations. You must tell people that your product or treatment will not work with or for everyone. You must also tell them that they should seek professional advice from their doctor or healthcare professional prior to taking anything or doing anything.
